NOTICE OF COLLECTION AND RETENTION OF BIOMETRIC IDENTIFIER<\/h2>\n\n\n\n

A feature of some of Forward Thinking Systems, LLC’s Products (as those Products are defined in Forward Thinking Systems’ Terms of Service, found here: https:\/\/www.ftsgps.com\/legal\/terms-of-service<\/a>) is the ability to use a camera installed in a vehicle to recognize if an unauthorized person is driving a certain vehicle. This is done by comparing the facial geometry of an authorized driver, such as yourself, to the facial geometry of the person actually driving the vehicle. Facial geometry refers to the shape and structure of the human face, which is unique to each person. Thus, for instance, if a vehicle is stolen, the Products can detect that the thief’s facial geometry does not match the facial geometry of an authorized driver. <\/p>\n\n\n\n

In order for this to work, the relevant Product must be able to scan and store your facial geometry for comparison. For any instance where Forward Thinking Systems\u2019 Products scan your facial geometry, Forward Thinking Systems will protect that information using the reasonable industry standard of care and with at least the same measures that Forward Thinking Systems uses to protect other confidential information. Forward Thinking Systems will also retain your facial geometry only for so long as the first of the following occurs, at which point it will be deleted:<\/p>\n\n\n\n

  1. The initial purpose of collecting your facial geometry has been satisfied, such as the termination of your employment with a Forward Thinking Systems’ customer, or Forward Thinking Systems discontinuing its Products; or,<\/li>\n\n\n\n
  2. Within three years of your last interaction with Forward Thinking Systems, such interaction including driving a vehicle for any of Forward Thinking Systems’ customers that use the Products. <\/li>\n<\/ol>\n\n\n\n

    Some of Forward Thinking Systems\u2019 Products are also able to more generally monitor driver behavior, such as determining whether a driver is using a cell phone or is otherwise distracted. While this does not involve scanning and storing your facial geometry for identification like the feature described above (and thus Forward Thinking Systems does not concede that this involves \u201cbiometric data\u201d as that term is defined under applicable law), it does involve visually monitoring your behavior such as your head position, line of sight, hand positioning, etc.<\/p>\n\n\n\n

    By typing your name below, you are consenting to Forward Thinking Systems and its Products scanning and storing your facial geometry. You are also acknowledging and consenting to Forward Thinking Systems and its Products visually monitoring your driving behavior as described above.<\/p>\n\n\n\n
